COOLED TRANSPORTED SEMEN CONTRACT
I
hereby agree to breed the mare________________________________, Reg. No.
______________, Breed __________ to the
Stallion___SR ROOSTERS KID_________________
using cooled transported semen, for the 2004 season subject to the following
conditions:
1. The Stallion Fee is $__800.00______, including a non-refundable booking fee of $350.00 that shall be due with the execution of this contract. NOTE: There is a $100 savings if booked before March 15, 2004. The above stallion fee includes the first shipment of cooled semen only. The stallion fee and all other applicable fees must be paid in full prior to shipment.
2. Request for semen must be received 24 hours prior to a regular scheduled breeding day. Stallion will be collected every other day starting February 15th until July 15th. No stallion will be collected on an “off” day unless specific arrangements are made with the King Equestrian Center Breeding Manager. Cancellation must be made by 6:00 a.m. shipping day. Mares on the premises of King Equestrian Center have breeding priority on any given breeding day; therefore we make no guarantee cooled semen will be available for a specific day. Shipped semen priority is based on order of request.
3. A $250.00
fee will be charged for each Cooled Semen shipment. This fee will cover
the costs of shipping the container by Federal Express (overnight
service). If semen is shipped in an Equitainer, the Mare’s Owner(s) is
responsible for the cost of returning the Equitainer by overnight service
(i.e. Federal Express). There is a $25.00
per day charge if the Equitainer is not returned within 72 hours after
shipment from King Equestrian Center. A separate check of $250.00
is required for Equitainer deposit; this is not a guarantee that an Equitainer
will be used. This deposit will be refunded upon return of the
Equitainer to King Equestrian Center and notification that no further
shipments are needed.
4. A Live Foal Guarantee will only apply to those mares that conceive and carry a pregnancy at least 60 days from insemination. A confirmation of pregnancy must be submitted from a veterinarian. Return breeding will only be honored if the mare is brought to King Equestrian Center the following season. A “rebreed” service charge of $250.00 will be charged on all return breeding. The Live Foal Guarantee in this contract is non-transferable and non-assignable.
4. Every effort will be made to accommodate your mare's breeding time frame; however, it is the mare owner's responsibility to keep in contact with King Equestrian Center so that your veterinarian and ours can get your mare in foal. If the mare fails to settle for any reason, mare owner will hold King Equestrian Center and representatives blameless.
5. The Stallion’s Owner will issued a “Breeder’s Certificate” for the foal conceived by this mating when all fees and other expenses have been paid in full; and when mare has produced a live foal by this mating. The Mare Owner shall be responsible for reasonable attorney fees and court cost if necessary to collect fees due. All accounts 30 days past due will be assigned a finance charge of 1 ½% per month on the unpaid balance, from date incurred.
6. This contract is entered into in the State of Idaho and will be interpreted and enforced under Idaho Law.
7. The Mare's Registration Certificate or a Photostat copy of the front and back of the certificate must be furnished. The owner recorded on the Mare’s registration certificate will be the name recorded on the Stallion Breeding Report.
8. When King Equestrian Center or their representative signs and returns one copy of this contract to me, it will then be a binding contract on both parties subject to the above terms and conditions. This contract is not valid unless completed in full and may not be altered or amended, except by written mutual consent of the parties herein. This contract is not transferable.
9. Mare Owner is responsible for completing and sending breed registrar (AQHA, APHA, etc.) the paper work upon receipt of the "Cooled Transported Semen" and is responsible for blood typing or DNA testing their mare and foal as per breed registrar rules (AQHA Rule #209, APHA Rule #RG-165, etc.).
